PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and Hydra Travels Inc., operating as Travyara.com ("Travyara," "we," "us," or "our"), governing your access to and use of the website www.travyara.com and all travel agency services provided through it. By accessing our website, creating an account, requesting a quote, or completing a booking, you confirm that you have read, understood, and unconditionally agreed to these Terms. If you do not agree, you must not use our services.

1. Definitions and Interpretation

In these Terms and Conditions, the following terms shall have the meanings ascribed to them below unless the context otherwise requires:

"ARC" Airlines Reporting Corporation, the accrediting body through which Travyara is authorized to issue airline tickets and process payments with participating airlines
"Itinerary" The confirmed travel plan including all booked services, dates, times, destinations, and relevant supplier confirmation numbers
"Travel Documents" Passports, visas, health certificates, vaccination records, and any other documents required for international or domestic travel
"Force Majeure" Events beyond the reasonable control of either party, including natural disasters, war, terrorism, pandemics, government actions, labor strikes, and similar circumstances
"Service Fees" Fees charged by Travyara for booking, consultation, change, or cancellation services, separate from supplier charges

In the interpretation of these Terms: (a) references to the singular include the plural and vice versa; (b) headings are for convenience only and shall not affect interpretation; (c) references to "writing" include electronic communications; and (d) references to applicable law include all amendments, replacements, and regulations made thereunder.

2. Nature of Services — Independent Travel Agency

Travyara.com is an INDEPENDENT TRAVEL AGENCY and is NOT an airline, hotel, car rental company, cruise line, or any other travel supplier. We act as an intermediary and booking agent on your behalf. Our role is to search, recommend, quote, and facilitate the booking of travel services offered by third-party suppliers. We do not own, operate, control, or manage the transportation, accommodation, or other services that you purchase through us.

Hydra Travels Inc. holds ARC accreditation (No: 45572424), which authorizes us to issue airline tickets on behalf of participating ARC-member airlines and to process payments for such ticketing through ARC settlement plans. ARC accreditation does not make us an agent or affiliate of any specific airline, nor does it create any employment, partnership, or joint venture relationship between us and any airline.

When you purchase travel services through Travyara, you are entering into one or more separate contracts with the relevant travel suppliers. We strongly urge you to read and understand the terms and conditions of each supplier, as those terms will govern your actual travel experience, cancellation rights, and remedies in the event of service disruptions.

3. Booking Process and Confirmation

3.1 How Bookings Are Made

Travel bookings can be made through the following channels: (a) our website at www.travyara.com; (b) by telephone during our business hours; (c) by email to our reservations team; or (d) through any other booking interface we may make available. You must be at least 18 years of age with legal capacity to enter contracts to make a booking. By making a booking, you represent that you have the authority to act on behalf of all travelers included in the booking.

3.2 Booking Confirmation

A booking is not confirmed until you receive a written confirmation from us, which will include the relevant supplier confirmation numbers, the itinerary details, the total price paid, and any applicable conditions. The receipt of a booking request or payment alone does not constitute confirmation. We reserve the right to decline any booking request at our sole discretion.

3.3 Traveler Information Accuracy

It is your sole responsibility to ensure that all traveler information provided at the time of booking is accurate and matches the government-issued identification that travelers will use at check-in. This includes full legal names (exactly as they appear on passports or IDs), dates of birth, passport numbers, nationality, and contact details. Errors in traveler names or other information may result in denied boarding, cancellation fees, or the need to rebook at a higher fare. We accept no liability for costs or losses arising from inaccurate information you have provided.

3.4 Minors Traveling

Bookings that include minors (travelers under 18 years of age) must be made by a parent or legal guardian who accepts these Terms on behalf of the minor. Unaccompanied minor policies vary by airline and must be arranged directly with the carrier. Some destinations require notarized parental consent letters for minors traveling internationally without both parents. It is your responsibility to verify and comply with all requirements relating to minors.

4. Pricing, Fees, and Payment

4.1 Fare and Rate Quotes

All prices quoted by Travyara are in United States Dollars (USD) unless otherwise specified and are subject to availability at the time of booking. Fares and rates are provided in real-time based on current supplier inventory and pricing. Quoted prices are not guaranteed until payment is received and booking is confirmed. Due to the dynamic nature of travel pricing, fares may change between the time of quotation and the time of booking confirmation.

4.2 Agency Service Fees

In addition to supplier charges, Travyara may charge service fees for our booking, consulting, and administrative services. These fees are disclosed to you before you complete any booking and are charged in consideration of the professional services rendered by our travel consultants. Agency service fees are generally non-refundable once a booking has been made, even if the underlying travel is subsequently cancelled, unless otherwise expressly stated.

4.3 Payment Terms

Payment is due at the time of booking unless a deposit arrangement has been expressly agreed to in writing. We accept major credit cards, debit cards, and other payment methods as indicated on our website. All payments are processed through PCI DSS-compliant payment systems. By submitting payment, you authorize us to charge the full amount to your designated payment method and confirm that you are the authorized cardholder or have authority to use the payment method provided.

4.4 Price Changes and Surcharges

After your booking is confirmed, we will endeavor to honor the confirmed price. However, travel suppliers may have contractual rights to impose surcharges after booking confirmation in certain circumstances, such as significant increases in fuel costs, currency fluctuations, or new government taxes. Where permitted by the relevant supplier's terms, such surcharges may be passed on to you. We will notify you of any such changes as soon as practicable and, where permitted by supplier terms and applicable law, offer you the right to cancel without penalty if the increase exceeds a material threshold.

5. Changes, Cancellations, and Refunds

All changes, cancellations, and refunds are subject to the terms and conditions of the relevant supplier(s) and our own agency policies. The following table provides a general overview of our approach to common scenarios.

5.1 Client-Requested Changes

To request a change to a confirmed booking, you must contact us as soon as possible using the contact information provided below. All change requests are subject to availability and the terms of the applicable supplier. We will advise you of any applicable fees, fare differences, and the total cost of the change before processing it. Changes are not guaranteed and may not be possible for non-flexible fares or fully booked services.

5.2 Cancellation Policy

Cancellation policies vary significantly between suppliers and fare types. Non-refundable fares and prepaid hotel rates typically result in forfeiture of the full booking price upon cancellation. Refundable fares may be cancelled for a full or partial refund, subject to timing and supplier rules. We will communicate the specific cancellation conditions applicable to your booking at the time of booking or upon request.

5.3 Refund Processing

Where a refund is due under the applicable supplier terms, we will process the refund to the original payment method used. Refund timelines are determined primarily by the supplier — airlines typically process refunds within 7-20 business days; hotel refunds may take 5-10 business days. Travyara has no control over supplier refund processing times. Our agency fees will not be refunded unless we have expressly agreed to do so in writing.

5.4 Airline Ticket Refunds — Special Provisions

As an ARC-accredited agency, we process airline refunds through the ARC settlement system. For refundable tickets, refunds are submitted to the airline through ARC and are credited to the original form of payment. For non-refundable tickets cancelled due to airline cancellation or significant schedule changes, you may be entitled to a refund under DOT (U.S. Department of Transportation) regulations. We will advise you of your rights upon notification of the relevant circumstance.

6. Travel Documents and Visa Requirements

It is the sole responsibility of each traveler to obtain, maintain, and carry valid travel documents required for their entire journey, including all transit points and destinations. Travyara provides general information about visa and documentation requirements as a courtesy only and such information should not be relied upon as legal advice or a guarantee of accuracy.

Re-Entry Documents Ensure you have all documents required to re-enter your home country, including any re-entry permits, green cards, or related documentation.
Children's Documents Minors may require additional documentation, including notarized parental consent letters when traveling internationally without both parents.
Airline Requirements Airlines may have documentation requirements in addition to destination entry requirements. Check with the operating carrier.

Travyara accepts no liability for any costs, losses, or consequences arising from a traveler's failure to obtain or carry appropriate travel documents, failure to meet health entry requirements, or denial of entry, boarding, or transit by any carrier, immigration authority, or government agency. The cost of any return journey necessitated by documentation failure will be the sole responsibility of the traveler.

7. Travel Insurance

We strongly recommend that all clients purchase comprehensive travel insurance to protect against unforeseen circumstances that may affect their travel plans. Travel insurance can provide coverage for trip cancellation and interruption, emergency medical expenses and evacuation, baggage loss, delay, and damage, airline failure and other travel supplier insolvency, and personal liability while traveling.

Travyara offers travel insurance products from licensed insurance carriers as part of our service offering. Travyara acts as an insurance agent or broker and is not the underwriter of any insurance product. All insurance terms, coverage details, exclusions, and claim procedures are governed by the insurance policy document issued by the carrier. We strongly urge you to read your insurance policy documents carefully upon receipt.

Declining travel insurance is entirely your right, but by doing so, you accept the full financial risk associated with non-refundable bookings, medical emergencies abroad, and other travel disruptions. If you decline insurance, we may ask you to sign or electronically acknowledge a declination of coverage.

8. Third-Party Supplier Terms and Conditions

All travel services facilitated by Travyara are subject to the terms and conditions of the relevant travel suppliers. These supplier terms are incorporated into and form part of your booking contract. By making a booking through Travyara, you acknowledge and agree to be bound by the applicable supplier terms.

Key supplier term categories that may affect your travel experience include:

  • Airline Conditions of Carriage: Governing passengers' rights regarding delays, cancellations, overbooking, baggage allowances, liability limits under the Montreal Convention or Warsaw Convention, and denied boarding compensation.
  • Hotel Cancellation and No-Show Policies: Including prepayment requirements, guarantee policies, and penalty charges for late cancellation or no-show.
  • Car Rental Terms: Including minimum age requirements, driver's license requirements, fuel policies, damage liability, insurance requirements, and geographic restrictions on vehicle use.
  • Cruise Line Passenger Ticket Contracts: Governing passenger rights, liability limitations, forum selection clauses, and health and safety requirements.
  • Tour Operator Booking Conditions: Including deposit schedules, payment timelines, minimum passenger requirements, and force majeure provisions.

Supplier terms are typically available on the supplier's website or upon request. Travyara will provide links to or summaries of key supplier terms where available, but it remains your responsibility to review and understand these terms before booking.

9. Limitation of Liability and Disclaimers

This section sets out the extent and limits of Travyara's liability to you. Please read it carefully

9.1 Travyara's Role and Liability

As an independent travel agency acting as an intermediary, Hydra Travels Inc. and Travyara.com's liability to you is limited to the services we directly provide — namely, the booking and administrative services rendered by our agency. We do not assume responsibility for the acts, omissions, negligence, breach of contract, or insolvency of any travel supplier.

9.2 Limitation of Damages

To the maximum extent permitted by applicable law, Travyara's aggregate liability to you for any claim arising from or relating to your use of our services or any booking made through us shall not exceed the total agency service fees actually paid by you to Travyara in connection with the relevant booking. In no event shall Travyara be liable for indirect, consequential, incidental, special, punitive, or exemplary damages, including loss of profits, loss of enjoyment, or emotional distress, even if advised of the possibility of such damages.

9.3 No Warranty

Our website and services are provided on an "as is" and "as available" basis. We make no warranty, express or implied, regarding the accuracy, completeness, or reliability of information on our website. We do not warrant that our website will be error-free, uninterrupted, or free from viruses or other harmful components. You use our website at your own risk.

9.4 Third-Party Responsibility

Travyara is not responsible for: (a) the quality, safety, legality, or fitness for purpose of any travel services provided by suppliers; (b) airline delays, cancellations, or overbooking; (c) hotel overbooking or failure to provide reserved accommodations; (d) car rental vehicle unavailability or mechanical failure; (e) cruise itinerary changes or port cancellations; (f) acts of terrorism, war, natural disasters, or other force majeure events affecting your travel; or (g) illness, injury, death, property damage, or other loss suffered during travel.

9.5 Force Majeure

Travyara shall not be in breach of these Terms or liable for any failure or delay in performance of our obligations to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, acts of terrorism, wars, government actions, labor disputes, or failures of third-party systems. In such circumstances, we will make reasonable efforts to assist you in rescheduling or obtaining refunds from suppliers, but our agency fees are not refundable on account of force majeure events.

10. Client Responsibilities and Obligations

By using our services, you agree to the following obligations and responsibilities:

  • Accurate Information: You represent and warrant that all information you provide to us is accurate, complete, and not misleading. You accept responsibility for all costs arising from inaccuracies in information you provide.
  • Compliance with Laws: You agree to comply with all applicable laws, regulations, and entry requirements of your origin, transit, and destination countries, including immigration, customs, health, and tax laws.
  • Travel Document Responsibility: You are responsible for obtaining and maintaining all necessary travel documents, including valid passports, visas, health certificates, and any other documentation required for your journey.
  • Compliance with Supplier Rules: You agree to comply with the conditions of carriage, house rules, and terms of all travel suppliers whose services you use. Failure to comply may result in removal from travel services without refund.
  • Fitness to Travel: You represent that all travelers in your booking are physically fit to travel and have disclosed any medical conditions that may affect their ability to travel or require special accommodations.
  • Supervision of Minors: You are responsible for the supervision and wellbeing of any minor travelers included in your booking.
  • Travel Insurance: You acknowledge our recommendation to purchase travel insurance and accept the financial risks of traveling uninsured if you choose to decline coverage.
  • Communication: You agree to respond promptly to our communications regarding your booking, particularly when changes, cancellations, or supplier notifications require timely action.
  • Lawful Use: You agree not to use our website or services for any unlawful purpose, including fraudulent bookings, money laundering, or identity theft.

11. Intellectual Property

All content on the Travyara.com website, including but not limited to text, images, logos, icons, graphics, page layouts, data compilations, software, and source code, is the proprietary property of Hydra Travels Inc. or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website for the sole purpose of planning and booking personal travel. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from our website without our prior written consent. Unauthorized use of our intellectual property is prohibited and may violate applicable intellectual property laws.

All trademarks, service marks, and trade names displayed on our website are the property of their respective owners. References to third-party trademarks, brand names, or products do not imply any endorsement, affiliation, or sponsorship unless expressly stated.

12. Website Use, Accounts, and Acceptable Use Policy

12.1 Account Registration

You may register for an account on our website to access enhanced features and manage your bookings. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 13. Dispute Resolution — Complaints Procedure

We are committed to resolving any concerns or complaints you may have about our services promptly and fairly. If you have a complaint about services provided directly by Travyara (i.e., our booking and agency services, not supplier performance), please follow this procedure:

Step 2: Formal Written Complaint If your issue is not resolved to your satisfaction at Step 1, submit a formal written complaint to our management team by email or certified mail within 60 days of the incident.
Step 3: Internal Review Our management team will acknowledge receipt of your formal complaint within 5 business days and provide a substantive response within 30 days.
Step 4: External Mediation If the complaint remains unresolved after Step 3, either party may request non-binding mediation through a mutually agreed mediator.
Step 5: Binding Arbitration If mediation is unsuccessful, disputes shall be resolved by binding arbitration as described in Section 14 below.
Complaints About Suppliers For complaints about airline, hotel, or other supplier performance, contact the supplier directly. We can assist with facilitating communications but cannot override supplier policies.

For complaints regarding airline services specifically, you may also contact the U.S. Department of Transportation's Aviation Consumer Protection Division at www.transportation.gov/airconsumer. For complaints about deceptive trade practices, you may contact the Federal Trade Commission at www.ftc.gov or your state attorney general's consumer protection division.

14. Governing Law and Arbitration

14.1 Governing Law

These Terms and Conditions and any disputes arising from or relating to them shall be governed by and construed in accordance with the laws of the State of [State to be Completed], United States, without regard to conflict of law principles. Where applicable, federal law (including the Montreal Convention for international air carriage) shall govern matters relating to international airline ticketing and passenger rights.

14.2 Mandatory Arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Except for small claims court actions and requests for injunctive or other equitable relief to prevent irreparable harm, any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or your use of our services, shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court.

14.3 Class Action Waiver

YOU AND TRAVYARA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Travyara agree otherwise, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of a representative or class proceeding.

14.4 Venue for Court Proceedings

For any matters not subject to arbitration, you consent to the exclusive personal jurisdiction of the state and federal courts located in [State/County to be Completed]. You waive any objection to the exercise of jurisdiction by such courts.

15. Indemnification

You agree to defend, indemnify, and hold harmless Hydra Travels Inc., Travyara.com, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, actions, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of any provision of these Terms; (b) your violation of any applicable law or regulation; (c) inaccurate information you have provided; (d) your use of our website or services in violation of these Terms; or (e) any claims by third parties arising from your travel itinerary or conduct during travel.

16. Modification of Terms

We reserve the right to modify these Terms and Conditions at any time to reflect changes in applicable law, regulatory requirements, our services, or business practices. When we make material changes, we will update the 'Last Updated' date at the top of these Terms and, where practicable, provide you with advance notice via email or a prominent notice on our website. The updated Terms will be effective as of the stated date.

Your continued use of our website and services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using our services. We recommend that you periodically review these Terms to stay informed of any updates.

17. Miscellaneous Provisions

No Third-Party Beneficiaries These Terms are for the benefit of you and Travyara only and do not create rights for any third party unless expressly stated.
Assignment You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in the event of a merger, acquisition, or sale of assets.
Notices Notices from us to you will be sent to the email or mailing address you have on file with us. Notices from you to us should be sent to the contact information in the Contact Us section.
Electronic Communications You consent to receive communications from us electronically and agree that electronic agreements and notices satisfy any legal requirement for written communications.
Headings Section headings in these Terms are for convenience only and shall not affect their interpretation.

18. ARC Accreditation and Regulatory Disclosures

Hydra Travels Inc. holds Airlines Reporting Corporation (ARC) accreditation, Accreditation Number 45572424. ARC accreditation means that we are authorized to sell airline tickets and process related payments on behalf of ARC-member airlines through the ARC settlement system. Our ARC accreditation is subject to ongoing compliance with ARC's Airline Agency Debit Memo (ADM) policies, the ARC Industry Agents' Handbook, and all applicable ARC terms of participation.
